Introduction

These Terms of Service (“Terms”) govern your participation in the texting communications program (“Program”) offered by Dawn V Gilmore Photography. By opting-in to receive text messages from us, you agree to these Terms.

1. Program Description
When you provide your mobile phone number and opt-in, you will receive recurring text messages from the Studio that may include appointment reminders, studio updates, promotional offers, news about sessions, and other relevant communications.

2. Message Frequency & Data Rates
You may receive up to 4 to 6 messages per months from us at the mobile number you provided. Message and data rates may apply according to your wireless plan; you are responsible for any such charges.

3. Consent & Opt-In
By providing your mobile phone number and opting into our Program, you expressly consent to receive recurring text messages from us to that mobile number. You confirm that you are the owner or authorized user of the mobile number. You also agree that we may send you marketing/promotional messages as described above.

4. Opt-Out / Stop
You may stop receiving text messages at any time by replying STOP to any message you receive from us. After you reply “STOP”, we will send no further marketing/promotional messages to that number (though you may receive a final opt-out confirmation message). If you want to receive messages again, you will need to opt in again.

6. Privacy Policy
Our Privacy Policy, located HERE, which describes how we collect, use, store and share your personal information. By joining our Program you agree to that Privacy Policy.

7. No Third-Party Data Sale
We will not sell or transfer your personal data to third parties for their independent marketing purposes. Your information will only be used by us (and our service providers) in accordance with the Privacy Policy.

8. Liability & Disclaimers
We make no warranty that the Program will be uninterrupted or error-free. We and our service providers shall not be liable for indirect, incidental or consequential damages. To the maximum extent permitted by law, our total liability related to the Program shall not exceed the fees you have paid to us (if any) or one hundred dollars ($100), whichever is less.

9. Changes to Terms
We may update these Terms at any time. The “Effective Date” will be updated accordingly. Your continued participation in the Program after changes means you accept the new Terms.

10. Governing Law
These Terms are governed by the laws of the State of Mississippi without regard to its conflict-of-laws principles.
